Figueroa, once one of Florida's highest-ranking federal law enforcement officers and the former head of a national program formed to target child sex predators, was arrested Oct. He was charged with exposure of sexual organs and disorderly conduct, which carry a potential punishment of more than a year behind bars. A sentencing hearing is tentatively scheduled for May 9 Rachel Wright, the 16-year-old who reported the incident, said Figueroa pulled up a leg of his shorts, exposed himself and masturbated for about 10 minutes. The suspect was Frank Figueroa, then one of Florida's highest-ranking federal law enforcement officers and the former head of a national program formed to target child sex predators. Figueroa is charged with exposure of sexual organs and disorderly conduct, which carry a potential punishment of more than a year in prison. He has pleaded not guilty Details of Figueroa's arrest and the incident that led to it were made public Monday with the release of documents in Figueroa's prosecution. Mall security reports portray Figueroa trying to get away and even pulling out his badge when first approached. He didn't resist officers and drove himself in his government car to waiting Orlando police. According to mall security reports, after Figueroa fled the scene, two more security officers approached him in the parking lot and asked why he was running. Officer Kevin Williams offered to help him find the car, but he said Figueroa first needed to talk to security about an incident in the food court. "Mr Figueroa then pulled out his government ID and stated to me that he didn't do anything in the food court," Williams' report states. Figueroa walked toward his car, and Williams followed, radioing to security Sgt. As Francisco approached the car, Figueroa pulled down the passenger-side sun visor in his government car, revealing red and blue strobe lights. Francisco told Figueroa that Orlando police were on the way and asked him to wait. Figueroa gave Francisco his office phone number and told him he needed to get back to Tampa for a conference. If Orlando police had any questions, Figueroa said, they could call him at work. Francisco radioed dispatch and then told Figueroa that Orlando police wanted him detained and taken to the security office. "Special Agent Figueroa gave an exasperated look but then asked if we could drive there." Francisco agreed and escorted Figueroa to the mall security office, where police took over the investigation. There is no indication in the released reports whether Figueroa gave police any statement or whether he invoked his right to remain silent. The files do contain a statement from Rachel Wright, the 16-year-old who reported the incident. If he is not removed from his job before August, the suspended agent will become eligible for retirement then when he reaches the age of 50. A spokeswoman for the Department of Homeland Security said the timing of a resolution to the case might affect Figueroa's pension. Although spokeswoman Jamie Zuieback stressed she could not address Figueroa's case specifically, she said that in general, if a federal employee is convicted of a crime and removed from a job before being eligible for retirement, he can request a refund of his pension contributions or wait until he turns 62 and apply for retirement benefits. |
