11/2    Since there appears to be an issue with mail right now, I will post
        a mail I was going to send to csua@csua here:
        The politburo has codified the constitutional amendment which will
        be voted on later this week.  This amendment adds two officers
        (Events Officer and Alumni Relations Officer) and changes a few
        other small things.  We encourage you to review it and if you are
        an active member (current students) join us tommorow to vote on it.

        \_ The two questions I would ask would be, do these really need to be
           voting politburo positions?  And, is it really likely that the
           CSUA will have seven people willing to be active in the
           politburo?  -tom
           \_ This was debated.  I thought a lot of the responsibilities
              would normally fall under the president, but the other politburo
              members thought it would bring more dedicated work if we allowed
              the ability to have a vote to a few typically sub-officer roles.
              Having a few more dedicated workers can also relieve some of
              the work responsibilities of other polit. members.  We will
              have to see how the numbers turn out.  There have been times in
              the past where 5 officers seemed hard to fill.  Reference the
              minutes for the most recent months (hopefully) they will have
              some more of the arguments about this. -mrauser
              \_ How much work is there for the officers? I find it hard to
                 justify having an ARO or not dividing the EO work between
                 the officers and "concerned" CSUAers.
                 \_ It's been a minimum of 5-10 hours a week, with many
                    weeks requiring more time. There have been several
                    initiatives that we have been unable to undertake b/c
                    we simply didn't have the time to do it. Every other
                    organization here has a minimum of ten officers and has
                    not had significant difficulty filling their positions.
                    If the positions go unfilled, then we're no worse off
                    then where we are now. If they are filled, it should
                    allow us to be more ambitious with our activities and
                    provide better service to students, by removing what is
                    currently the greatest bottleneck to this goal.

                    \_ The problem I see is the need for X/2 or X/3 officers
                       to do certain tasks. Minor, but puts you in an odd
                       spot if you only have 4 officers out of 6.
        \_ I suggest that the Alumni Relations Officer position should be
           opened to CSUA associate members (alumni) as well as current
           students.  Yes, this means that an alumnus can end up as a voting
           member of Politburo.  An alumnus who runs should be available for
           Politburo meetings and related activities (i.e., located near
           Berkeley and have time for it).  If they get too busy for CSUA,
           replacement procedures can treated equivalently as if a student
           member resigned.  In terms of whether it's okay to have a former
           Berkeley student on the executive committee of an ASUC-sponsored
           club, I think it should be okay if they represent just 1 out of 7
           votes.  What do people think?  How about asking it this way:
           Would there be any alumni out there who would seriously run for
           such a position, be located near Berkeley, and have time for it?
           \_ As much as it is hard to fill 5 positions at times, it will be
              even harder to fill 7, but I think it would be near impossible
              to get a commitment from alumni to consistently be in and around
              the CSUA post-graduation.  Coming to weekly meetings isn't all
              that politburo members do, there are a lot of other "being
              around berkeley" types of things that need to get done.  It
              would also require us to change the constitution to allow an
              alumnus to vote.  We plan to review how the most recent amend-
              ments have effected CSUA come spring semester.  If the A.R.O.
              isn't effective we can do away with/change the position.

              \_ I want to elaborate on your "near impossible to get a
                 commitment" comment.  Basically, students (while possibly
                 being super-busy if they're in the College of Engineering),
                 have the flexibility of having open slots during the day.
                 In contrast, an alumnus with a job typically has a 9-5
                 work schedule.  Politburo shouldn't need to work around that.
                 Anyways, the official Berkeley policy prevents alumni from
                          mr/ms moot: have you actually
                          looked up the defn in a reputable
                          dictionary? look up "cleave" while
                          you are at it. -\

              Okay, never mind, it's stated pretty clearly that it's not
              possible:
              "Only currently registered students, faculty and staff may be
              active members in a registered student organization. Only active
              members may vote or hold office."

                    the Politburo.

Constitution of the Computer Science Undergraduate Association Article I Name This organization shall be hereinafter referred to as the Computer Scienc e Undergraduate Association, also known as the CSUA. Purpose The purposes of this organization are: to represent the undergraduate com puter science student body in dealings with the University of California at Berkeley, its representatives, and any other appropriate organizatio n; to provide a forum for the personal interaction of persons involved i n the computer sciences; to promote knowledge of and interest in the com puter sciences; Membership A Active Membership Any currently registered undergraduate student of the University of Calif ornia at Berkeley is eligible for active membership in the CSUA. B Associate Membership Any student, staff, faculty member of the University of California at Ber keley or former active member may hold associate membership in the CSUA. C Criteria Only currently registered students, faculty and staff may be active membe rs in a registered student organization. we wil l not restrict membership based upon race, color, national origin, relig ion, sex, physical or mental disability, medical condition (cancer-relat ed or genetic characteristics), ancestry, marital status, age, sexual or ientation, citizenship or status as a covered veteran (special disabled veteran, Vietnam-era veteran or any other veteran who served on active d uty during a war or in a campaign or expedition for which a campaign bad ge has been authorized). D Effective time of membership An applicant's membership is not effective until after the meeting at whi ch the applicant joins. D Duties 1 President The President shall: * chair, or appoint the chair for, the meetings of the CSUA * be responsible for the execution of mandates reflecting organization policy as determined by the organization's active members and its officers in General and Politburo Executive Meetings * be primarily responsible for representing the CSUA in its duties as t he undergraduate computer science students' representative body * maintain contact and communication with the University, its faculty m embers responsible for teaching computer science, and any other relevant organization * appoint chairs for the various committees, subject to confirmation by the Politburo; Vice President The Vice President shall: * assist the President in execution of duties * be chief assistant to the President in matters regarding the allocati on of resources of the CSUA * assume the office of the President in case of resignation or removal from office of the president or, with approval of a quorum of the politburo, appoint an eligible member to assume the office of president * be responsible for assuming the duties of the President in case of pr olonged explained absence of the President * be the chief administrator of any computer equipment maintained by th e CSUA * have any other duties and/or responsibilities set forth in this Const itution. Treasurer The Treasurer shall: * maintain a publicly available record of all financial transactions, l iabilities, and credits relating to the CSUA * report on the financial status of the CSUA to its members and officer s * obtain primary signatory power with the ASUC as soon as possible afte r election * have any other duties and/or responsibilities set forth in this Const itution. Secretary The Secretary shall: * maintain all necessary non-financial records of the organization * take minutes at Politburo and General meetings * assist the other officers in execution of their duties * have any other duties and/or responsibilities set forth in this Const itution. Librarian The Librarian shall: * maintain the CSUA Library * administer the CSUA's physical resources * have any other duties and/or responsibilities set forth in this Const itution. Article V Committees The Politburo The Politburo shall consist of all elected officers of the CSUA. It shall hold at least three open meetings a semester while school is in regular session. The Politburo shall determine temporary policies of the CSUA. Politburo decisions may be overturned by a two-thirds vote of the genera l membership at a general meeting. Other Committees Other committees may be created or dissolved at the direction of either t he Politburo, or by a majority vote of the general membership at a Gener al Meeting. Election of Officers A Time and Place of Elections Officers shall be selected each semester by a majority vote of the attend ing General Membership at a General Meeting held no less than two weeks before the last day of instruction, announced no less than one week in a dvance, and held at a time and place that is considered generally access ible as well in compliance with ASUC regulations concerning accessibilit y of ASUC sponsored activities. B Procedure The chair shall appoint an election officer, who shall not vote or run fo r office. Members shall be nomina ted until no more are willing and eligible. No person shall be nominated who is not willing to serve upon their election, and no person not pres ent can be nominated for an office without his or her written consent be ing presented at the meeting. If only one candidate is in nomination vot ing may be done by acclamation. Otherwise voting shall be done by secret ballot of active members. A ballot that is blank or otherwise does not uniquely identify a nominated candidate shall not be counted. If there is at any time a majority for a candidate, that candidate wins. If there is no majority and there are two candidates the election office r shall cast the deciding vote. If there is no majority and there are th ree candidates, the one with the fewest votes shall be eliminated. If th ere is a tie among those with the fewest votes the election officer shal l select one to be eliminated. If there are more than three candidates, three shall be selected to proce ed to a runoff round as follows. Select as many candidates as possible f or the runoff, starting from those with the highest vote totals, until i t is impossible to proceed without selecting more than three or discrimi nating between candidates who received the same number of votes. If it i s not possible to select any candidates in this way because there is a t ie for first, the election officer shall cast a vote for one of the tied first-place candidates. If there are then fewer than three candidates s elected for the runoff round, a new vote shall be held among those candi dates not already chosen to select the remaining candidates. Removal and Replacement of Officers A Removal An officer may be removed from office in one of the following ways: * In the event of extended unexplained absence of an officer, the offic e may be declared vacant by a majority of the remaining officers. B Replacement In case of removal or resignation from office of one of the elected offic ers except the President, the President shall appoint a successor. All s uch appointments to office must be confirmed by a majority vote of the P olitburo at the next announced Politburo meeting. As stated in Article I V, in the event the office of President is vacated for whatever reason, the Vice-President shall either assume the office of president without n eed for confirmation and appoint a successor to be approved by a majorit y vote of a quorum of the Politburo, or, with the approval of a majority vote of the Politburo at the next announced Politburo meeting, appoint an eligible member to assume the office of president. Contact an OSL Advisor PREPARING A CONSTITUTION Your constitution is the official statement of how your group intends to operate. The constitution is required for registration with the Office o f Student Life, and it will serve as a guide for your group as you make leadership changes and make decisions about your groups activities. When creating your constitution you will need to consider such things as what to call your group and how to present your purpose to others, who y our members will be, what type of organization structure your group will have, how you will run meetings and make decisions and how you will dea l with changes in leadership. Below are the required guidelines to follow when preparing your constitut ion for submission to OSL. Additionally, we have compiled some suggestions and things to consider fo r all aspects of your constitution. Please note that some sections have reuqired text which must be included word-for-w ord in order for your constituion to be approved. ARTICLE I Name What is the exact title that will be used in addressing your organization ? IMPORTANT NOTE: Registered student groups may not use the University of C alifornia, Berkeley or any abbreviations (eg UC) as part of their name or in conjunction with their programs. Other terms, such as campus or Berkeley campus may be used by a registered organization as part of i ts name. Are there any restrictions on University students (eg, grade point average, class standing)? If your organizat ion will be recognizing off-campus participants, you are required to inc lude a statement about these non-active members. Student groups are required to include and abide by the following stateme nts: Only currently registered students, faculty and staff may be active membe rs in a registered student organization. we will not restrict membership based upon race, color, national origin, religion, sex, physi cal and mental disability, medical condition (cancer-related or genetic characteristics), ancestry, marital status, age, sexual orientation, cit izenship or status as a covered veteran (special disabled veteran, Vietn am-era veteran or any other veteran who served on active duty during a w ar or in a campaign or expedition for which a campaign badge has been au thorized). ARTICLE IV - Officers/Elections List the officers by title (eg, President) or define the leadership str ucture if another system is used (eg, spokesperson by consensus). Describe the process and required majority of votes by your active, voting membership by which officers will be elected or s elected. What is t he required majority of votes by your active, voting membership to remov e or replace an officer? ARTICLE VI - Constitutional Amendments Who can propose an amendment? What is the required period of time between the proposed amendment and a final vote? How wil l you notify active members that an amendment is going to be voted upon? Incorporate into your constitution that an amendment will need a two-th irds majority vote from your active membership in order to pass. Amendme nts change the structure of the group and it is important to have that t wo-thirds approval from the members at large. Student groups are required to include and abide by the following stateme nt: All amendments, additions or deletions must be filed with the Office of S tudent Life, 102 Sproul Hall. Additionally all ASUC and Graduate Assembly-sponsored organizations must include the following statement: All amendments, additions or deletions must be filed with the ASUC Office of Student Affairs, 400 Eshleman Hall within one week of adoption. ARTICLE VII Dissolution How will dissolution be decided? What is the required majority of votes t o dissolve the group? We encourage organizations to include an article in the constitution, cit ing the parliamentary authority to be used for points not covered in the constitution. Many organizations cite Roberts Rules of Order, latest e dition. All ASUC and Graduate Assembly-sponsored organizations must include the f ollowing statement: All unspent ASUC funds shall remain the property of ASUC, all Graduate As sembly funds shall remain the property of the Graduate Assembly. Remain ing privately-obtained funds may be donated to another nonprofit organiz ation with prior approval of the ASUC Senate Finance Committee.
