           The bubble hasn't happened yet, but if it happens, it'll burn a lot
           of individual investors. Since it's a risky business, how about
           starting a corporation that borrows money from banks and from
           individual investors to buy up huge amount of properties, and maybe
           even buy sections of big cities? They can make huge profits by
           renting out properties or flipping them to other individual
           investors? If things go sour, the corporation shares the risks
           so no one gets burned badly, and worst case comes they can
           always declare bankruptcy. Is this legal? Possible? Can
           corporations buy blocks of land or buy cities and make huge
           profits since they have no competitors?"

                       members and flip the house for 1/4 of the profit
                       (minus club fees), I've made a lot of money in the
                       past 2 years this way, and now have enough to flip
                       a few houses of my own. If I can do it, SO CAN YOU!
                       Don't wait! Do it while the market is still hot. All
                       indications show that sales of homes rose AGAIN in
                       June. Despite liberal naysayers yapping about the
                       bubble, the Bush economy is really working and

           as natural, since home buyers get a big tax break that frequently
           goes into the hundreds of thousands of dollars if they live in the
           house for two years, and if you're the big company, you don't get

           \_ True, rental real estate does not get the 250K/500K tax free
              treatment of residental real estate.  However, you do get to
              roll one rental unit over to the next rental unit and put
              off paying taxes on your profits.  I've always assumed that
              there are not companies owning and renting out many residential
              units because the business doesn't scale well.  And of course
              being a new landlord today is just awful for cash flow.

Adding together the two categories, single-family home sales h ave gone from a rate of about 65 million in mid-2002 to about 8 million last year to 87 million as of last month. Housing starts have been steady at a rate of more than 2 million a year for the past three months, which is considered strong although a bit below the rate of Janu ary and February, which was boosted by hurricane-related rebuilding in t he South. The latest pricing data also offered more evidence for what one industry analyst called a "frenzy" in sales. The national median price for existi ng homes jumped to a record $219,000, up 15 percent from a year ago, the fastest rate of growth in 25 years, according to the National Associati on of Realtors, a trade group. That pushed the Realtors' affordability i ndex, which compares incomes with home prices, to its lowest level in 14 years. com Capital gains home-sale tax break is a boon for most owners Tuesday July 26, 6:00 am ET Kay Bell What's the best tax break available to Jane and John Q Public? Homeowners already know the many tax breaks that Uncle Sam offers, most n otably mortgage interest and property tax deductions. Well, he also has good tax news for home sellers: Most of them won't owe the Internal Reve nue Service a single dime. When you sell your primary residence, you can make up to $250,000 in prof it if you're a single owner, twice that if you're married, and not owe a ny capital gains taxes. "Most people are not going to have a tax obligation unless their gain is huge," says Bob Trinz, a senior tax analyst at RIA, which provides tax i nformation and software to tax professionals. Some sellers are surprised by this break, especially if they've been in t heir homes for a while. That's because before May 7, 1997, the only way you could avoid paying taxes on your home-sale profit was to use the mon ey to buy another, more-expensive house within two years. They could take a once-in-a-lifetime tax exemption of up to $125,000 in profits. And in all instances, there was tax paperwork (Form 2119) to fill out to show that you followed the rul es. But when the Taxpayer Relief Act of 1997 became law, the home-sale tax bu rden eased for millions of residential taxpayers. The rollover or once-i n-a-lifetime options were replaced with the current per-sale exclusion a mounts. "There is some logic to this law change because most people under the pri or rules didn't recognize a taxable gain because they rolled it over int o another residence," says Trinz. "The change essentially makes it easie r to dispose of your residence." Still some requirements to meet If you used pre-1997 rules for residential sales, don't worry. That doesn 't disqualify you from claiming the exclusion on any residential sales n ow. The law change applies to all sales since it took effect. Another bonus of the new rules: You don't have to buy another home with y our sale proceeds. You can use the money to travel to Europe in style, b uy an RV and drive across the country or get all those designer shoes yo u never could afford before. Even better, there's no limit on the number of times you can use the home -sale exemption. In most cases, you can make tax-free profits of $250,00 0 (or $500,000 depending on your filing status) every time you sell a ho me. You did notice that phrase "in most ca ses," didn't you? Before you put a "For Sale" sign in the yard, you need to make sure your house-sale situation is one of those "most cases." First, the property you're selling must be your principal residence. This tax break doesn't apply to a house or other property that you have solely for investment purposes. You can, however, turn a rental house into your primary residence, making the sale of it eligible for the exclusion. This is accomplished when yo u meet the IRS use and ownership tests: You own and live in the home for two out of the five years before the sale. "Generally, if you owned and used the home as your main home for periods totaling at least two years within five years ending on the date of thes e sale, you're eligible for the exclusion," says RIA's Trinz. This would apply if you owned a home for five years, but didn't us e it as your primary residence for that full period. For the first three years, you rented it and then moved into it as your main home for the f inal two before you sold it." But you don't even have to live in the house at the date of sale. The fle xibility of the use test means you could live in your house for a year, rent it for two, move back in for another year and rent it again the yea r before you sell. Since during those five years you owned and lived in the property for two years, you meet the use and ownership tests. Finally, while technically there's no limit on the number of homes you ca n sell and reap tax-free gain, each sale must be at least two years apar t That still leaves you room to make some money on several properties. You can sell your residence this year, pocket any gain within the tax li mits and buy a new residence. Two years later, you can do the same thing , again and again every two years. There even are situations where owners of multiple properties might be ab le to double up on the tax-free gain. "There might be instances where you sell your primary residence and then establish your vacation home as your primary home for a couple of years and then sell that home," says Trinz. "Empty nesters who have a large su burban home could move into a vacation home at the beach and then as the y get older move to a residential facility so they can sell both the hom es and not have any taxable gains." Be careful, however, if you move into a rental property you acquired thro ugh a like-kind exchange. The American Jobs Creation Act that was signed into law on Oct. If the p roperty you convert to your principal residence is one that you earlier obtained via a property swap, in order to take advantage of the home-sal e exclusion you must have acquired the property at least five years earl ier. Michael E Kitces, director of financial planning for the Pinnacle Adviso ry Group in Columbia, Md, gives this example: A property is acquired by like-kind exchange in 1999, converted to personal use as a residence in 2002 and then sold in late 2004. Since the like-kind property was owned for five years, it meets the new tax code ownership-length provision. A nd having met the new five-year acquisition rule for a swapped property, Kitces says, the owner qualifies for the capital-gains exclusion since he lived in the property for two years after its conversion. If, however , the property had been exchanged in 2001, even if the seller had made i t his principal residence shortly after the date of the swap and thereby met the two-year use rule, he still would be not be able to exclude any profits on the sale. In either case, though, the pesky reporting requirement remains history. When your gain doesn't exceed the limit, you don't have to file anything with the IRS. Special rules for married couples While a husband and wife get double the exclusion of single home sellers, couples also have some additional considerations when it comes to deter mining whether their sale is tax-free. For example, the IRS says it's OK if you owned the home for the last two years, but you just added you r new husband to the title when you got married six months ago. Since yo u owned the residence for the requisite time, as joint filers you have n o problem meeting the ownership test even though your husband wasn't an official owner for that long. But the shared use doesn't have to be while you file jointly. If you and your now-husband shared the home for 1 years before tying the knot and then six months as newlyweds, the IRS will allow you to claim the exemption. But if he didn't move in unt il the wedding day, you're out of tax-exclusion luck. And while you're learning about your new spouse, make sure you find out a ll about his or her previous home-sale history. "The two-year eligibilit y rule applies to both spouses, so full home disclosure is another finan cial area you need to consider when getting married," says Trinz. Under this couple requirement, if either spouse sold a home and used the exclusion within two years of the sale of any jointly-owned property, th e couple can't claim the exclusion. That means if your new husband sold his townhouse a month before the wedding, then you'll have to wait two y ears after that property's sale date before you can dispose of your shar ed marital residence tax-free. Figuring the correct exclusion amount OK, you (and your better half if you're married) met the use and ownershi p tests, as well as the two-year previous-sale time limit. Now it's time to do the math to avoid writing a big check to the US Treasury. As a seller, you naturally focus on how much you got for your house. In August, 1946, Cliffie Stone, then an assistant prod ucer and talent scout for Capitol Records, called Merle Travis (a Capito l hitmaker at that time) about recording a 78 rpm album (four discs in a binder) of folk songs. Capitol, seeing the success of a Burl Ives album , wanted their own folk music album. Merle told Cliffie he figured, "I ves has sung every folk song." Stone suggested Travis write some new son gs that sounded folky, and to do so quickly; the first four-song session was scheduled for the next day. Travis recalled the traditional Nine Po und Hammer and wrote three songs that night about life in Muhlenberg Cou nty, Kentucky's coal mines, where his father worked. The song's chorus came from a letter Merle received from his brother lame nting the death of World War II journalist Ernie Pyle, killed while cove ring combat in the Pacific in 1945. John Travis wrote, "It's like workin g in the coal mines. Merle also recalled a remark his father w ould make to neighbors when asked how he was doing: "I can't afford to d ie. " This referred to coal-company owned stores where miners bought food and supplies with money advanced b y the company, called "scrip". Later released on Capitol's 1947 LP "Folk Songs From The Hills", the song almost immediately began to generate controversy, causing Travis himsel f, problems, in the anti-communist, Cold War hysteria of the late forti es. Some in government saw songs dealing with workers' woes, and folk mu sic "activists" as potentially subversive. It made no difference that Tr avis was a true American patriot. Veteran Capitol producer, Ken Nelson, who worked at WJJD radio in Chicago in the late forties, recalled in a 1 992 interview that FBI agents advised the station not to play Travis' re cords, because they considered him a "communist sympathizer," which was, of course, completely untrue. Ernie knew the song from working with Travis on Cliffie Stone's Hometown Jamboree, and revived it on his daily NBC show early i n 1955. Within five days, NBC received over 1200 letters from viewers as king about the song. In July, Ernie performed the song live at the Indi ana State Fair, in front of a capacity crowd of 30,000. In September, reeling from a demanding road and television production sch edule, Ernie was informed by Capitol that he was approaching breach of c ontract. He needed to record two sides for a single release immediately. Armed with a box of fan mail, Cliffie Stone convinced Capitol head Lee Gillette to allow Ernie to record "Sixteen Tons", and Gillette agreed; i t would be the B side of a country-blues swinger titled "You Don't Have To Be A Baby To Cry", a tune that Gillette and others at the label beli eved would be Ernie's biggest hit yet. On September 17, 1955, both songs are recorded at Capitol's Melrose Avenue Studios in Hollywood. mistakenly left on the master tape by Gillette and the engineers. But, inexplicably, radio stations coast to coast began 'flipping' the si ngle and playing the B side. In eleven days following its release, 400,000 singles are sold. Demand fo r the song was so great, that Capitol geared all its pressing plants nat ionwide to meet the deluge of orders. In Twenty-four days, over one mill ion records were sold, and "Sixteen Tons" became the fastest-selling sin gle in Capitol's history. By November, it had captured the top spot on e very major record chart in the country, and by December 15 (less than tw o months after it's release) more than 2,000,000 copies were sold, makin g it the most successful single ever recorded. Merle Travis--already celebrated as a guitar innovator a nd songwriter--was immortalized by the song. In later years, when perfor ming the song himself, he altered the final stanza to, "I owe my soul... On July 29, 1956, he returned to his boyhood h ome of Ebeneezer, Kentucky, to unveil a granite monument the town built to immortalize his accomplishments, including Sixteen Tons. In 1991, his ashes were buried under that monument, and remain ther e to this day. On October 17, 1991, thirty-six years to the day after the release of "Si xteen Tons", Ernie Ford passed away, closing the chapter on one of Ameri can music's most compelling, legendary stories.
