The lawsuit seeks more than $50,000 in damages from Edward Hospital and 2 3-year-old Jose Rostro, who is accused of taking the photos in October. The suit, which was filed Friday, also alleges Edward Hospital was neglig ent in hiring, retaining and supervising Rostro. Edward spokeswoman Deborah Linton said officials did not know of the laws uit regarding Rostro's alleged actions. Twenty-three-year-old Rostro has been charged with unauthorized videotapi ng. Messages left with a Jose Rostro from Bolingbrook were not immediate ly returned today.
