           \_ Thanks.  It is almost always amusing to read the comments
              by the freepers.  It is also very informative -- not about the
              original article but about the freepers themselves.  They appear
              mostly to be poorly programmed robots.  Despite all their
              mistrust of the government all but one seemed to know for sure
              the fed is right and she is guilty of spying for China.  In fact
              they seem to know the right answer to everything.  If only we
              could have a regime change to put them in power.

srm913 US judge hits Leung prosecution David Rosenzweig January 8, 2005 Charging prosecutors with willful and deliberate misconduct, a US federal judge has dismissed all criminal charges against a former FBI informant accused of serving as a double agent for the mainland. The pledge was contained in an agreement that retired agent James Smith r eached with the government this year allowing him to plead guilty to a r educed charge of failing to report his 20-year affair with Leung. Under long established rules, prosecutors are prohibited from obstructing a de fendant's access to witnesses. At a hearing before Cooper last month, Assistant US Attorney Michael Emmi ck disavowed any intent to prevent Smith from speaking to Leung's defens e team. He blamed inartful'' language in Smith's plea agreement. Leung's lawyers, John Vandevelde and Janet Levine, said they were gratifi ed with the dismissal. Leung, a naturalized citizen, was recruited by Smith during the early 198 0s to gather intelligence for the FBI during her frequent business trips to China, where she ingratiated herself with high-ranking government of ficials. But starting about 1990, prosecutors said, she began working for the Chin ese as well, feeding sensitive information about the FBI to her handler at the Ministry of State Security. Smith learned about her activities bu t covered them up and continued to vouch for her reliability, he admitte d in his plea deal. Leung was not charged with espionage but with illegally copying and posse ssing classified documents. The prose cution committed an egregious violation of basic legal tenets (the Sixth Amemdment to the US Constitution, specifically) by charging Leung usi ng testimony from a source it then attempted to shield from cross-examin ation and possible impeachment. It was thrown out only due to alledged p rosecutorial miscondict, not on the facts of the case. She is clearly lo yal or supportive of the communists and her association with the highest levels of the communist leadership are known Lee, in my opinion, was a Clinton victim, used as a smokescreen scapegoat to deflect from Chinagate and loss of important waepons info. His case was not thrown out and was eventually dropped as a plea bargain due to lack of evidence. Evidence against leung, on the oth er hand, is apparently clear and the context of her associations are sup portive of her apparent role as a double agent. It seems stupid to let her off rather than fire or reprimand the miscondu ct of the DA's office. sarcasm L OS ANGELES, April 16 It was no secret in political and social circles here that Katrina Leung, a long-time FBI informer who is accused of being a Chinese double agent, liked the good life. Ms Leung, a 49-year-old businesswoman who was arrested last week, dresse d impeccably, gave lavish parties at her home in San Marino, owned vario us businesses and property, and frequently flew overseas. But the extent of Ms Leung's assets, which the authorities have describe d as "enormous and complex," has begun to emerge in recent days, althoug h a full accounting may never be known. At a bail hearing for Ms Leung on Tuesday, federal prosecutors said that she and her husband, Kam Leung, had access to at least $872,000 in bank and retirement accounts in the United States and that the couple might have had millions of dollars in foreign accounts under different names. United States Assistant Attorney Rebecca Lonergan said Ms Leung could us e these assets if she chose to flee the United States. The prosecutor sa id Ms Leung, a naturalized American citizen, had not reported hundreds of thousands of dollars in overseas earnings on her United States tax re turns. In addition, Ms Leung claimed mortgage interest deductions on a Californ ia residence that was not in truth mortgaged, Ms Lonergan said. Citing her "significant foreign assets" as a flight risk, Federal Magistr ate Victor B Kenton on Tuesday ordered Ms Leung held without bail unti l trial on charges of illegally obtaining secret documents from her Fede ral Bureau of Investigation handler, with whom she had a sexual affair. The magistrate said that despite the best efforts of the authorities, "th ere is much about the defendant's financial wherewithal that has not bee n revealed in the court." In a statement released today, Ms Leung's lawyer, John Vandevelde, asked that the public "not jump to any conclusions" regarding the government' s portrayal of his client's assets. "Information is being withheld from us, and the government has only shown the tip of the iceberg," Mr Vandevelde said. "When all the information is out it will show that for 20 years the FBI controlled everything and knew everything that Ms Leung did. " Ms Leung, who is said to have extensive contacts in the Chinese governme nt, was recruited by James J Smith, an FBI agent who was her main ha ndler and lover for 20 years until his retirement in 2000. Mr Smith has been charged with gross negligence in his handling of natio nal security documents that officials say Ms Leung copied and passed on to the Chinese government. At the bail hearing for Ms Leung, her lawyers argued that the FBI was fully aware of their client's every action and approved them. They said Ms Leung's home in San Marino, a rich suburb just east of Los Angeles, was equipped with built-in microphones and video cameras that a llowed American agents to spy on her Chinese house guests. "The FBI fed information to her and encouraged her to give it to the P eople's Republic of China in order to obtain the trust of the PRC and obtain information in return," according to the documents filed by Ms Leung's lawyers. Underscoring what prosecutors said was Ms Leung's vast wealth, she and h er family had offered to post bail for as much as $2 million in property to secure her release. Her husband, brother and sister, all attended th e hearing but declined to be interviewed. Ms Leung, who wore a green windbreaker jacket and navy blue sweat pants, was escorted into the courtroom in shackles. Her hair pulled back in a long ponytail, Ms Leung appeared relaxed and confident. Prosecutors provided some details of the sources of Ms Leung's assets an d the complex financial schemes they said she used to hide them. For starters, they said Ms Leung had received $17 million for work and expenses as an informer for the FBI in which she provided the agency with secret material on the Chinese government over 20 years. Ms Leung, who is fluent in Cantonese, Mandarin and English, also was pai d $12 million in 1995 and 1996 for negotiating a deal that allowed Nort el Telecommunications to do business in China, prosecutors said. As Nortel's representative, Ms Leung, who used the business name "Merry Glory" for the deal, received 3 percent of any contract that she obtaine d for Nortel, they said. Prosecutors said a review of Ms Leung's personal tax returns showed that she reported neither the FBI payments nor the Nortel payments as inc ome on her on federal income tax filing, as required by the Internal Rev enue Service. According to an affidavit filed by federal prosecutors in connection with the bail hearing, Ms Leung admitted to the authorities that she had tw o bank accounts in Hong Kong under the name Merry Glory and Right Fortun e The accounts were used "to create the appearance of a separate creditor t o which she made mortgage payments when in fact she was paying herself," the document stated. Ms Leung bought her home in San Marino about 12 years ago for $14 milli on, prosecutors said. She made a down payment of half that amount and fi nanced the balance. She deposited payments from Nortel in her Right Fortune account and used the money to pay off the balance of her mortgage. "This created the appe arance she had refinanced with another company and enabled her to falsel y claim mortgage interest deductions for her residence after she had in fact paid her mortgage in full," the affidavit said. Nancy Mathis, a spokeswoman for the Internal Revenue Service in Washingto n, said that because of privacy laws that protect all taxpayers the agen cy could not comment on whether it would investigate Ms Leung in connec tion with tax fraud. Lo-Pro Ex-FBI, Chinese lover arrested in spy case Female double-agent had affairs with 2 FBI men By Sherrie Gossett Retired FBI agent James Smith was arrested Wednesday on charges he repeat edly allowed a Chinese double agent, with whom he was having an affair, to gain access to classified information. Smiths lover, Katrina Leung, a 49-year-old San Marino resident and Repub lican party activist, was also arrested. The arrests were made after a 13-month FBI investigation that included co vert surveillance, interviews and consensual and covert searches. Leung had been an FBI asset under Smiths supervision for almost 20 yea rs. She was purportedly providing information about the People's Republi c of China (PRC) to the FBI. During this period Leung was paid approxima tely $17 million for providing the FBI with the information. Now she is alleged to be a double-agent, who was also working as an asse t for the Chinese Ministry of State Security (MSS). The MSS is an intelligence service of the Peoples Republic of China (PRC) . Among other functions, MSS conducts intelligence operations for the P RC focusing upon the United States intelligence community, including the FBI, the Central Intelligence Agency (CIA), the National Security Agenc y (NSA), the Defense Intelligence Agency, the military, the National Rec onnaissance Office, and the National Imaging and Mapping Agency. According to the FBI, Leung admitted that she had an MSS handler named "M ao." "Luo" was her MSS alias, provided to her by a high ranking PRC offi cial. Smith routinely debriefed Leung at her residence and allegedly on occasio n took classified documents there and left them unattended. Leung surrep titiously photocopied some of them, and documents she obtained in this m anner have been recovered from her residence. Leung admitted that she also made notes regarding documents she surreptit iously obtained from Smith without copying the documents. Leung also mad e notes regarding information Smith told her. Over the years, Leung provided intelligence she gained in this manner to the MSS Exposed double-agent still had access to classified info In 1991, Smith learned Leung was providing classified information to PRC intelligence services without authorization by the FBI. Smith learned this from an FBI Special Supervisory Agent (SSA) who oversa w a Chinese counterintelligence squad in the San Francisco . Ironically, this agent has also now admitted to a long-term sexual relationship wit h Leung. The unnamed agent recognized Leungs voice on a recording provi ded by a source. He in turn alerted Smith and allegedly relied on him to handle the situati on. Despite the revelation, Smith continued to allow Leung access to classifi ed information. An FBI search of a bookshelf at Leungs residence turned up the following : - a FBI Los Angeles NSD-2 squad telephone directory dated December 20, 19 94; "Royal Tourist" was the code name of an espionage investigation of Peter Lee. TRW in California and admitted passing secr et restricted information to the PRC during travel to the PRC in 1985. I n 1997, Lee pled guilty to unauthorized transmission of national defense information. security breaches continued into retirement After retiring, the unnamed San Francisco-based agent obtained employment with the University of California. The job required a security clearanc e, and provided the former FBI SSA access to classified information. The FBI states that the former agent had not reported his sexual relationsh ip with Leung to the University of California either. Former agent Smith also continued to provide information about the FBI an d FBI agents to Leung after he retired. The information sought by PRC intelligence services includes the identiti es of FBI employees and the nature of FBI investigations. FBI Director Robert S Mueller commented, "The allegations against former Agent Smith and his source Katrina Leung are serious. Allegations that he caused the loss of classified information, as well as his personal in discretions with Ms Leung, are very serious and warrant a strong respon se. adding, James Smith wa s once a Special Agent, sworn to uphold the rule of law and the high eth ical standards of the FBI. According to today's charges, former Agent Sm ith not only betrayed the trust the FBI placed in him, he betrayed the A merican people he was sworn to protect. Smith began his career with the FBI in October 1970 and retired in Novemb er 2000. Smith transferred from his first FBI office in Salt Lake City, Utah, to the Los Angeles Office in 1971. In approximately July 1978, Smi th was assigned to work on a Foreign Counterintelligence (FCI) squad foc using upon the PRC. From that time until his retirement, Smith worked on FCI PRC matters. Katrina Leung was active in California Republican politics. At a speech g iven before the Los Angeles World Affairs Council on October 22, 2002, f ormer gubernatorial candidate and Republican William Simon referred to L eung as a dear friend. Leung and Smith both made their initial court appearance yesterday. AbeLincoln A retired FBI agent who was in charge of Chinese counter-intelligence in California is under arrest, sources told ABCNEWS. He was being held in conn ection with his former job, sources said, but the charges were not immed iately available. Sources said Congress was being briefed on the arrest before it is announ ced to the public, which was expected to happen later today. Department of Justice officials declined to comment on the case.
