IN THE HOUSE OF REPRESENTATIVES January 7, 2003 Mr RANGEL (for himself, Mr MCDERMOTT, Mr CONYERS, Mr LEWIS of Georgia , Mr STARK, and Mr ABERCROMBIE) introduced the following bill; which w as referred to the Committee on Armed Services A BILL To provide for the common defense by requiring that all young persons in the United States, including women, perform a period of military service or a period of civilian service in furtherance of the national defense and homeland security, and for other purposes. Be it enacted by the Senate and House of Representatives of the United St ates of America in Congress assembled, SECTION 1 SHORT TITLE; SHORT TITLE- This Act may be cited as the Universal National Service Act of 2003'. TABLE OF CONTENTS- The table of contents for this Act is as follows: Sec. Registration of females under the Military Selective Service Act . Relation of Act to registration and induction authority of Milit ary Selective Service Act. OBLIGATION FOR YOUNG PERSONS- It is the obligation of every citizen o f the United States, and every other person residing in the United States, who is between the ages of 18 and 26 to perform a period of national service as prescribed in this Act unless exempted under the provisions of this Act. FORM OF NATIONAL SERVICE- National service under this Act shall be pe rformed either-- as a member of an active or reverse component of the uniformed servic es; or in a civilian capacity that, as determined by the President, promotes the national defense, including national or community service and homeland security. INDUCTION REQUIREMENTS- The President shall provide for the induction of persons covered by subsection to perform national service under this Act. SELECTION FOR MILITARY SERVICE- Based upon the needs of the uniformed services, the President shall-- determine the number of persons covered by subsection whose servi ce is to be performed as a member of an active or reverse component of the uniformed services; and select the individuals among those persons who are to be inducted for military service under this Act. CIVILIAN SERVICE- Persons covered by subsection who are not selec ted for military service under subsection shall perform their national service obligation under this Act in a civilian capacity pursuant to subsection . GENERAL RULE- Except as otherwise provided in this section, the perio d of national service performed by a person under this Act shall be two years. GROUNDS FOR EXTENSION- At the discretion of the President, the period of military service for a member of the uniformed services under this Act may be extended-- with the consent of the member, for the purpose of furnishing hospita lization, medical, or surgical care for injury or illness incurred in line of duty; or for the purpose of requiring the member to compensate for any time lo st to training for any cause. EARLY TERMINATION- The period of national service for a person under this Act shall be terminated before the end of such period under the following circumstances: The voluntary enlistment and active service of the person in an activ e or reverse component of the uniformed services for a period of at least two years, in which case the period of basic military training and education actually served by the person shall be counted toward the term of enlistment. The admission and service of the person as a cadet or midshipman at t he United States Military Academy, the United States Naval Academy, the United States Air Force Academy, the Coast Guard Academy, or the United States Merchant Marine Academy. The enrollment and service of the person in an officer candidate prog ram, if the person has signed an agreement to accept a Reserve commission in the appropriate service with an obligation to serve on active duty if such a commission is offered upon completion of the pro gram. IN GENERAL- The President shall prescribe such regulations as are nec essary to carry out this Act. MATTER TO BE COVERED BY REGULATIONS- Such regulations shall include s pecification of the following: The types of civilian service that may be performed for a person's na tional service obligation under this Act. Standards for satisfactory performance of civilian service and of pen alties for failure to perform civilian service satisfactorily. The manner in which persons shall be selected for induction under thi s Act, including the manner in which those selected will be notified of such selection. All other administrative matters in connection with the induction of persons under this Act and the registration, examination, and classification of such persons. A means to determine questions or claims with respect to inclusion fo r, or exemption or deferment from induction under this Act, including questions of conscientious objection. Standards for compensation and benefits for persons performing their national service obligation under this Act through civilian service. Such other matters as the President determines necessary to carry out this Act. USE OF PRIOR ACT- To the extent determined appropriate by the Preside nt, the President may use for purposes of this Act the procedures provided in the Military Selective Service Act (50 USC App. IN GENERAL- Every person subject to induction for national service un der this Act, except those whose training is deferred or postponed in accordance with this Act, shall be called and inducted by the President for such service at the time and place specified by the President. AGE LIMITS- A person may be inducted under this Act only if the perso n has attained the age of 18 and has not attained the age of 26. VOLUNTARY INDUCTION- A person subject to induction under this Act may volunteer for induction at a time other than the time at which the person is otherwise called for induction. CLASSIFICATION- Every person subject to induction under this Act shall, before induction, be physically and mentally examined and shall be classified as to fitness to perform national service. The President may apply different classification standards for fitness for military service and fitness for civilian service. HIGH SCHOOL STUDENTS- A person who is pursuing a standard course of s tudy, on a full-time basis, in a secondary school or similar institution of learning shall be entitled to have induction under this Act postponed until the person-- obtains a high school diploma; HARDSHIP AND DISABILITY- Deferments from national service under this Act may be made for-- extreme hardship; TRAINING CAPACITY- The President may postpone or suspend the inductio n of persons for military service under this Act as necessary to limit the number of persons receiving basic military training and education to the maximum number that can be adequately trained. TERMINATION- No deferment or postponement of induction under this Act shall continue after the cause of such deferment or postponement ceases. QUALIFICATIONS- No person may be inducted for military service under this Act unless the person is acceptable to the Secretary concerned for training and meets the same health and physical qualifications applicable under section 505 of title 10, United States Code, to persons seeking original enlistment in a regular component of the Armed Forces. OTHER MILITARY SERVICE- No person shall be liable for induction under this Act who-- is serving, or has served honorably for at least six months, in any c omponent of the uniformed services on active duty; or is or becomes a cadet or midshipman at the United States Military Aca demy, the United States Naval Academy, the United States Air Force Academy, the Coast Guard Academy, the United States Merchant Marine Academy, a midshipman of a Navy accredited State maritime academy, a member of the Senior Reserve Officers' Training Corps, or th e ...

BushCo is planning to conscript everybody up to the age of 34 for all kinds of dut y! In May, the Seattle Post Intellig encer published an article about a document they received through the Fr eedom of Information Act. It was revealed that the SSS is currently des igning procedures for the implementation of a Skills Draft and had he ld a top-level meeting on it with Deputy Undersecretaries at the Defense Department. This draft would change the essential mission of the Select ive Service and require virtually every young American, male and femal e ages 1834, to register for the Skills Draft and list all the occupati ons they are proficient in to fill labor shortages throughout nearly the entire government. If enacted, the Skills Draft proposed in this FOI-re covered document would change America as we know it. The Pentagon is suffering from immediate labor shortages. Recently, the i nactive Ready Reserve had to be called up for the first time since the G ulf War to fill 5,600 job shortages in the Armed Forces. DoD said in the recent IRR callup 20% of the call-ups are truck drivers, 12% are suppl y specialists who can use a computer to track supplies, 10% are Humvee m echanics, 7% are administrative specialists and 6% are combat engineers (USA Today, August 8, 2004). Although Congress would have to approve new legislation to create a Skill s Draft or reinstate the combat draft, Family Circle reported in its Jul y 13 issue that Karl Rove had polled GOP members of Congress in Septembe r 2002 to see if they would support the President if he requests reinsta tement. They would l ikely support the new legislation needed to create the Skills Draft. Whi le Bush and the Republicans are of course keeping the return of the draf t and the new skills draft as quiet as possible, many anti-draft organiz ations have recently begun warning of a Coming New Draft. a partial explanation of it that was printed May 1, 2004. Rosenbergs article was edited, however, and some key points about this do cument were omitted in the published article. This document is real, having been acknowledged by the DoD and the S SS when they said no action is being taken on it at the present time. Ho wever, given the current manpower shortages for certain skills and nurse s, if Bush gets back in, expect all the options outlined in the Issue Pa per to be implemented by the end of December of this year, and at the le ast a non-combat skills and medical draft to start next year, if not the male combat draft, ages 1825. Despite Rumsfeld saying the draft is not needed, this is the same neo-con administration that has repeatedly lied to and misled the American peop le. Draft-age youth and their families are left looking at a long, hard slog in Iraq (Rumsfeld secret memo), the neo-con plans to invade still more nations, and then having to take Rumsfeld and Cheneys word not to worry about the draft, that they are not considering it at this time. Although official word is that this secret list of options is not being i mplementedthe Issue Paper options have NOT been rejected and the 6-page proposal is rather sitting in the Pentagon, waiting. In addition, the S SS itself has said that it is designing procedures (Seattle PI, May 1, 2004) to implement the skills draft, meaning designing the compliance c ards and the data fields needed to keep track of virtually every young American and their skills. Acting Director of the SSS Brodsky has also said the Skills Draft is the top priority of the Selective Service for 2004. From the FOI document, we now know that on February 11, 2003, Charles Abe ll, the Deputy Undersecretary of Defense for Personnel and Readiness, an d William Carr, Deputy Undersecretary for Military Personnel Policy, met with Lewis Brodsky, the Acting Director of the Selective Service and so me other officials. This is the highest-level meeting you could have abo ut the Selective Service, outside of Rumsfeld and his inner circle. They were there to discuss the urgent issue paper now revealed, which star ts: With known shortages of military personnel with certain critical sk ills, and with the need for the nation to be capable of responding to do mestic emergencies as a part of Homeland Security Planning, changes shou ld be made in the Selective Service Systems registration program and pri mary mission. Although it would require changes in current draft law, the far-reaching proposal shows how far the Republicans are going to plan and prepare for a huge expansion of the draft. The Issue Paper options include: * Change the very mission of the SSS to become a massive conscription s ervice in the War on Terror for the entire government. This database would be used to draft in war and to recruit in peacetime. State and even local governments would be given access to the names for recruitment and help in emergencies. The self-declaration is similar to IRS compliance and the filling out and signing of your tax forms. All young people would be required to keep the government updated if they acquired a new skill. SSS Compliance forms will be available at every Post Office. The usual penalties of imprisonment and/or a $250,000 fine would apply to all non-registrants. This greatly increases your chance of being drafted if you are 1834. This secret paper urges the mission be changed promptly, meaning they r eally need it, it would draft for the Pentagon as well as the enormous H omeland Security branches as well as other government agencies, even sta te and local! For obvious political reasons, the decision was made by Bush, Cheney and Rove to sit on this 6-page proposal until after the election in November . Yet the SSS was told to go ahead and begin designing procedures for the Skills Draft in 2004 and make it their top priority. It can be exp ected that if Bush gets back in, and the DoD and SSS are still asking fo r the Skills Draft, the Next Steps part of the document will be put in to action and the most expansive option to change the SSS mission will b e rapidly legislated. In the secret planning meeting document, the next steps strongly recommen ded by SSS Acting Director Brodsky were: 1 Promptly redefine the SSS Mission to draft men and women up to age 3 4 for skills, and deliver them within 90 days or sooner to the Departmen t of Defense. Program a massive database to be ready to enter millions o f names of those registering their critical skills. This proposed expansion of the draft, forcing all people under 35 to regi ster with the SSS, man or woman, is primarily proposed, according to the document, because the cost of providing contract professionals, like co mputer network specialists, would be prohibitive. In this way, the pro posed Skills Draft would help preserve Bushs massive tax cuts for the w ealthy by lowering the massive budget deficits. Thats the new Skills Draft and the secret document behind it. Selective Service has been registering young men for over twenty years an d at any moment the President can go to Congress and ask them to reautho rize conscription for the male combat draft for ages 1825. It doesnt t ake much to imagine a re-elected Bush going to Congress and saying We c annot cut and run from Iraq or the War on Terror. And they would not have to pass a whole new draft law to do it. Charles Rangel introduced a bill in Congress Tue sday to reinstate the military draft, saying fighting forces should more closely reflect the economic makeup of the nation. The New York Democrat told reporters his goal is two-fold: to jolt Americ ans into realizing the import of a possible unilateral strike against Ir aq, which he opposes, and "to make it clear that if there were a war, th ere would be more equitable representation of people making sacrifices." "I truly believe that those who make the decision and those who support t he United States going into war would feel more readily the pain that's involved, the sacrifice that's involved, if they thought that the fighti ng force would include the affluent and those who historically have avoi ded this great responsibility," Rangel said. "Those who love this country have a patriotic obligation to defend this c ountry," Rangel said. "For those who say the poor fight better, I say gi ve the rich a chance." According to Rangel's office, minorities comprise more than 30 percent of the nation's military. Under his bill, the draft would apply to men and women ages 18 to 26; exe mptions would be granted to allow people to graduate from high school, b ut college students would have to serve. Anyone who didn't qualify for military service because of impairments wou ld be asked to perform community service. The lawmaker has said his measure could make members of Congress more rel uctant to authorize military action. The Korean War veteran has accused President Bush and some fellow lawmakers of being too eager to go to war . Defense Secretary Donald Rumsfeld told reporters Tuesday he sees no need for a draft. He said the military is managing to attract enough skilled recruits without one. "The disadvantages of using compulsion to bring into th e armed forces the men and women needed are notable." Draft controversy The nation had a draft in place between 1948 and 1973. It grew to become the center of controversy during the Vietnam War, 1964-1975, an undeclar ed war that was the most unpopular conflict America has fought. Anger over the war led many young men to flee to Canada and elsewhere to avoid the draft, and violent protests were rampant. When the draft ended , the United States set up an all-volunteer military. Since 1980, the Selective Service has required men 18 to 26 to register t o give the government a pool of men it could draw from in case troops we re needed in an emergency. As of October 31, 141 million men would be eligible for a draft, said Se lective Service spokesman Pat Schuback. Twenty-year-olds would be called up first, followed by others -- year by year. In the age group 20 to 26 , 11 million would be eligible. The average number of men registered per year during the Vietnam War era was 184 million. That covers the period from July 1, 1964, through June 1973.

San Francisco Chronicle Washington -- The government is taking the first steps toward a targeted military draft of Americans with special skills in computers and foreign languages. The Selective Service System has begun the process of creating the proced ures and policies to conduct such a targeted draft in case military offi cials ask Congress to authorize it and the lawmakers agree to such a req uest. Richard Flahavan, a spokesman for the Selective Service System, said plan ning for a possible draft of linguists and computer experts had begun la st fall after Pentagon personnel officials said the military needed more people with skills in those areas. "Talking to the manpower folks at the Department of Defense and others, w hat came up was that nobody foresees a need for a large conventional dra ft such as we had in Vietnam," Flahavan said. "But they thought that if we have any kind of a draft, it will probably be a special skills draft. " Defense Secretary Donald Rumsfeld has said he would not ask Congress to a uthorize a draft, and officials at the Selective Service System, the ind ependent federal agency that would organize any conscription, stress tha t the possibility of a so-called "special skills draft" is likely far of f A targeted registration and draft is "is strictly in the planning stage," said Flahavan, adding that "the whole thing is driven by what appears t o be the more pressing and relevant need today" -- the deficit in langua ge and computer experts. "We want to gear up and make sure we are capable of providing (those type s of draftees) since that's the more likely need," the spokesman said, a dding that it could take about two years to "to have all the kinks worke d out. " The agency already has in place a special system to register and draft he alth care personnel ages 20 to 44 in more than 60 specialties if necessa ry in a crisis. According to Flahavan, the agency will expand this syste m to be able to rapidly register and draft computer specialists and ling uists, should the need ever arise. But he stressed that the agency had r eceived no request from the Pentagon to do so. The issue of a renewed draft has gained attention because of concerns tha t US military forces are over-extended. But Congress, which would have to authorize a draft, has so far shown no interest in renewing the draft. Legislation to reinstitute the draft, introduced by Rep. The military draft ended in 1973 as the American commitment in Vietnam wa ned, beginning the era of the all-volunteer force. Mandatory registratio n for the draft was suspended in 1975 but resumed in 1980 by President J immy Carter after the Soviets invaded Afghanistan. About 135 million me n, ages 18 to 25, are registered with the Selective Service. But the military has had particular difficulty attracting and retaining l anguage experts, especially people knowledgeable about Arabic and variou s Afghan dialects. To address this need, the Army has a new pilot program underway to recrui t Arabic speakers into the service's Ready Reserves. The service has sig ned up about 150 people into the training program. A Pentagon official familiar with personnel issues stressed that the arme d forces were against any form of conscription but acknowledged the grou ndwork already underway at the Selective Service System. "We understand that Selective Service has been reviewing existing organiz ational mission statements to confirm their relevance for the future," t he official said. "Some form of 'special skills' registration, not draft , has been a part of its review."
