10/14 anybody have experience whistle blowing or getting a news organization to write about something using internal info? My company is laying off american workers here and hiring a shitload of indian programmers. What the fuck? I want more coverage on shit like this. \_ Are they laying off workers in the US and hiring them for the office in india? \_ Time to look for another job. Based on my experience with h1b fops (as opposed to h1bs with grad degrees from a US school), they are probably the only group of programmers on earth worse than the '1337 GN00/L1NUX crowd. Placing products in h1b hands invariably means buggy code that is delivered late. Buggy products that are late don't sell well in most markets, which will lead to the untimely demise of your company (sold or bankrupt). The first should be deported and the other needs some legal punishment. I'm sure that you if gave real hard evidence to those being laid off that they could sue the company for lotsa $$$. rather than face publicity, a company usually will settle with the employees that sued. some employees sign away their right to sue when they agree to a severance package. give these people a smoking gun now before it's too late. \_ Imagine this scenario: There are one million IT workers. The economy doubles, one million H1B visa workers are added. Now there are two million IT workers. The economy goes in the toilet, we now have one million IT jobs lost, and there are only one million IT jobs left. Is it feasible, and would that make sense? If you are an employer and you have two employees, 1 an H1B and the other an American citizen or PR. Both of them have worked at the company for 3 years. Let's assume that H1B is the better employee in terms of skills and dedication. So you decide to layoff the American citizen. Would you consider that as breaking the law? \_ Is it fair to fire everyone H1b before a single American? Yes. That's what the law says. That's the risk the H1b takes when coming here on an H1b. (or is supposed to be taking) Your hypothetical situation is not what the H1b covers or has anything to do with. Of course you keep your H1b DBA and lay off the American janitor. \_ I disagree. I think it should only be during hiring when the American should have preference over an H1B worker. The preference should not exist when deciding whom to layoff. When hiring, American workers are, in principle, protected by the requirement that a H1B worker's salary meets prevailing wages requirements. Breaking the law: "Hiring a H1B worker to replace an American citizen." Not breaking the law: "Firing an American citizen instead of a H1B worker based on performance and merit." \_ You realise that in an at-will job market like CA, your plan has about, oh, 5.7 zillion loop holes in it? And that's still not the law. \- what do you suggest is fair in that scenario? seniority only? cut everyone back to 20hrs/week? i realize this often fails but i think companies do have some sense to look at efficiency not just expense ... so if you are 50% more productive but make 30% more than a h1b, then you should be secure. now if the problem is you arent that much more productive, then you do have a problem. but except for the nationlistic aspect this is the same thing middle-aged people with "20yrs experience" whine about when some kid whose only friend is his PS2 replaces him ... because the kid is willing to work until 10pm and on weekends in exchange for free tshirts and soda. --psb \_ The H1b is supposed to be making market rate. www.zazona.com/ShameH1B/Horror.htm I want to keep myself anonymous, as my story did not go out of our four walls. In India I tried for 6 years to find a job after finishing my Masters degree. Because of rampant corruption, nepotism, political infuences (which I was lacking, and aginst my concious) I could not find a job. Then God listened to my prayers and I got an opportunity to come to this Land of Opportunity. After I came here, I was facinated by computers and technology, which I had never even seen a key board in India, and pursued my career. I finished my BS, and MS Computer Science and positoned in a good job. But all of a sudden these Indian labor started flooding here. They do not have a formal degree in computers, all they have is a one month programming training in some garage. Some of them not even have college degree and started making more money ( $80 - $100 an hour). D, and making much lower salary than those high school graduates, and I dropped out. In the mean time Indian colleges realized the computer boom and introduced a new program called 'Master in Computer Applications (MCA)' which is a one year diploma after high school. Indians started taking this course, and convinced US corporations that they have Masters degree in computer science. US corporations thought they are getting an MCA (Masters) for cheaper rate than what they are paying to BS computer science programmer, and started replacing them. At workplace where I used to work 9 out of 12 team members are H1-B Indians. One guy said he has been in Computer field since 1983 in India. The term 'computer program' was never heard there until 1988. Another "software engineer's" resume says he has been working as a software engineer since 1995 in Bank One. I have scores of such examples about these so called H1-B software engineers and their qualifications. My wife and I have two masters degrees each in computer science, and engineering. One fine morning, the bomb (downsize) exploded- we both got laid off on the same day (we were working for different corporations). Because it spreads fastly to back home and to old age parents. I was interviewed couple of times by TCS, and Wipro, and they almost offered me the job. But the minute I told them that I am US Citizen, they said their project was on hold. So far I have not heard even single H1-B guy who is unemployed. These Indian outsourcing companies are bribing the IT managers and successfully get their job done. The prime element that drove me out of India (corruption), is agin drove me out of my job. After working for 18 years as a Senior Analyst/Test Lead Programmer, I was called into my managers office at an Insurance Company in Hartford, and introduced to 5 Indian programmers from COGNIZANT SYSTEMS, INDIA. I was told that I was to teach these people everything I knew about the system I was working on. S citizens who started working at the company the same time as me. These Indian programmers were on L-1 visas and their team leader on a H1B. Even Chinese and Russians workers were given the boot and replaced by Indians. I have written to my State Representatives and Joined TORAW in the vain hope that something be done about this situation. I'm sad to say that things for NON-INDIANS are even worse now than when I got laid off a year ago. In my most recent position I was computer programming for a small consulting firm. The firm needed some part-time help so I encouraged the most intelligent person I met at the local college to apply. My greedy employer happily hired her for $10/hr to do Access development work. They advertised for my own position in local newspapers while I was working there to show that they could not find people and then sponsored the Russian for a green card. As soon as I had trained the new women I was fired for printing about $40 worth of paper material containing a typo. The Russian is still there working for $10 and waiting for her permanent visa. Sorry, But I can not sign this without fear of reprisal from my former employer. I think it is NOT just the HIB visa that is killing local employment. I am 34, have a 4 yr professional engineering degree in Electrical and Electronic Engineering, and am working in IT since 1995. I do firewall administration, router configuration, intrusion detection, server migration etc etc. With years of experience, and hands on, you can categorise me as a veteran expert. For the past 2 years, I am trying to get a new job as I am unhappy with my present job and pay. For the 1000 or so applications I sent out, I did NOT get a single offer for an interview even. Remmeber I am working for 8 years in IT, and I study one to two hour per day after work. They are young (most in their mid 20s), and are being hired by MNC for good posts like senior consultant etc. If you speak nice to them you will learn that his/her degree is in biology or any and then he did some 6 months course at some 'institute'. I would like to say that in India, you can get an engineering degree at some 'college' no matter your performance in high school provided that you have money. There is no strict (or even slack) admission criteria for institutions providing degrees in India. Once one Indian friend promised to find me job, provided that I pay the first 4 months salary to the agency. He says, a 'part' will goto the hiring manager of the company. Once an Indian becomes to a hiring position, he will not hire anyone BUT indians. You ask whether he can do 'ANY JOB', he will boast 'he has been doing it for years' although he may not know what he is talking about. Remeber, even I, after years of experience and learning, say that " I did not do it previously, but I can refer to this and do it. In March 2003, my manager asked me how well I knew the product I was working on. A few weeks later, we got an email from our contracting firm telling us that IBM was cutting contractor rates another 5%. When I complained about the rate cut to my IBM manager, she had my contract terminated. I have been unemployed since April 2003 and have sent out hundreds of resumes and haven't even gotten a nibble. I decided to leave hi tech altogether when I encountered other unemployed hi tech workers at a local Reemployment Center who had advanced degrees and had been out of work for 2 years. I start back to our local community college to pursue a Sonography (ultrasound) degree. I have been trying to get my tuition and books paid for by a federally-funded program called WIA (Workforce Investment Act). I applied to the program in June 2003, the person I was working with at the Worksource Career Center, took so long to get anything done that it was the middle of August before I finally got submitted for approval. I was finally sent an email the week before Fall classes started telling me that the funds had been frozen. After spending the day making phone calls, I finally found out that they had run out of WIA funding for the fiscal year and would not get refunded until October. However, it will be the Spring semester before it will do me any good, that is provided I get approved. I am a developer for AT&T Wireless in Bothell Washington. I am also a lifetime member of the Disabled American Veterans Association, former AD Army military Police Officer, and a former employee of the US Immigration service. I left INS to take the opportunity offered to me in the world of IT with AT&T Wireless. I started with AT&T Wireless on September 11, 2000, and am currently the last American left from a team of over 30 a year ago. AT&T Employees are being threatened with firing and no severance if they don't cooperate in training the TCS folks on how to take over their jobs. Today in a meeting we reamining developers were asked to tell TCS how long it would take TCS tolearn our applciations. Apparently TCS does not know how to evaluate the expertise of their own employees. There has been no news coverage of AT&T Wireless' massive offshoring efforts. I have emailed senator patty murray of Washington state, and was replied with that she is fighting to get more unemployment benefits.
